1. Introduction

Welcome to Refov!

Refov s.r.o. with its registered seat in Bratislava - mestská časť Ružinov, Doležalova 3424/15C, Postcode 821 04, the Slovak Republic, ID No. 56 790 325, registered in the Commercial register of the District court Bratislava III, Section Sro, Insert 185498/B ("Refov"), issues this document under the conditions specified below.

Refov is a platform connecting job seekers, referrers, and employers in an innovative and trusted network. By accessing or using Refov, you agree to comply with these Terms of Service. If you do not agree, please refrain from using our platform.

2. Definitions

  • • Platform: Refov, available at [Refov.com].
  • • User: Any individual or entity using Refov, including job seekers, employers, and referrers.
  • • Job Seeker: A person seeking employment opportunities through Refov.
  • • Employer: A company or individual posting job openings on Refov.
  • • Referrer: A user who facilitates connections between job seekers and employers and receives a bonus for successful referrals.
  • • Bonus: A monetary reward paid by the employer to the referrer upon a successful job placement.

3. Acceptance of Terms

By registering or using Refov, you confirm that you have read, understood, and agreed to these Terms of Service.

4. Eligibility

  • Users must be at least 16 years old to register on Refov. However, users must also meet the minimum legal working age in their country of employment. If the legal working age in a user’s country is higher than 16, they may not use Refov for employment purposes until they reach the required age.
  • Employers must comply with all applicable employment laws in the European Union (EU) and their country of operation, including but not limited to national labor codes, non-discrimination regulations, fair hiring practices, and any industry-specific requirements. Employers are solely responsible for ensuring that job offers and employment conditions adhere to legal obligations in the relevant jurisdiction.

5. User Accounts

  • Users must provide accurate and up-to-date information during registration.
  • Users are responsible for maintaining the confidentiality of their account credentials.
  • Refov reserves the right to suspend or terminate accounts for violating these terms or engaging in prohibited activities.

6. User Obligations

6.1 General Obligations

Users must comply with all applicable laws and regulations. Users must not:

  • Post unlawful, harmful, or offensive content.
  • Attempt unauthorized access to the platform.
  • Engage in fraudulent or deceptive activities.
  • Discriminate or harass other users in any manner.

6.2 Employer Obligations

  • Employers must provide accurate job descriptions and ensure compliance with Slovak labor laws.
  • Employers must fulfill the bonus payment obligation to Refov after a successful placement when the job seeker accepts the position.

6.3 Referrer Obligations

  • Referrers must act honestly and only recommend job seekers they genuinely believe are suitable for the role.

6.4 Job Seeker Obligations

  • Job seekers must provide accurate and truthful information about their qualifications, experience, and skills.
  • Job seekers must respond promptly to communications from employers and referrers.
  • Job seekers must not:
    Misrepresent their identity or credentials.
    Apply for roles they are not genuinely interested in.

7. Payment Terms

  • Employers are required to pay the agreed-upon bonus amount for successful job placements.
  • Refov collects the bonus amount from the employer after a successful placement when the job seeker accepts the position.
  • After successful placement, Refov pays 90% of the bonus amount to the referrer and retains 10% as a platform fee. This payment is processed within 15 days of the successful placement.
  • Disputes regarding payments must be reported to Refov within 30 days.

8. Taxes and Compliance

  • 8.1 Referrers as Independent Participants
    Refov operates as a platform connecting employers, job seekers, and referrers. Referrers act as independent participants and are not employees, agents, or representatives of Refov. They engage in referrals on their own behalf and are responsible for managing their own income. Nothing in these Terms creates an employment, partnership, or agency relationship between Refov and referrers.
  • 8.2 Referrers' Responsibility for Taxes
    Referrers acknowledge that they are solely responsible for determining and fulfilling their tax obligations in their respective countries. This includes, but is not limited to, income tax, VAT, social security contributions, business registration fees, or any other applicable taxes related to earnings received through Refov. It is the referrer’s duty to comply with local tax regulations.
  • 8.3 Employers' Responsibility for Taxes
    Employers using Refov must comply with all tax obligations in their country of operation. This includes proper tax reporting, social security contributions, and any withholding tax requirements. Refov is not responsible for employer tax compliance and does not verify tax adherence by any party.
  • 8.4 No Tax Withholding by Refov
    Refov does not act as an employer or tax agent for referrers or employers. The platform does not withhold, collect, or remit any taxes on behalf of users. Each referrer and employer is responsible for reporting and paying any applicable taxes in accordance with their local tax laws.
  • 8.5 Compliance with Local Laws
    Referrers and employers must ensure that their participation on the platform adheres to all applicable tax, licensing, and business registration laws in their respective countries. Refov is not responsible for verifying tax compliance and does not provide tax documentation, withhold taxes, or offer tax advice. Referrers must comply with tax laws in their country of residence and consult a professional if needed.
  • 8.6 Reporting to Authorities
    If required by law, Refov may disclose information about users’ earnings to tax authorities, in compliance with legal obligations. Users are responsible for maintaining accurate financial records.
  • 8.7 Indemnification
    By using Refov, referrers and employers agree to indemnify and hold Refov harmless from any claims, penalties, fines, or legal actions arising from their failure to comply with tax regulations. Refov assumes no responsibility for any user’s tax obligations.
  • 8.8 Right to Suspend Accounts for Tax Non-Compliance
    Refov reserves the right to suspend or terminate a referrer’s or employer’s account if there is evidence of tax fraud, failure to comply with tax laws, or violations of these Terms.

9. Content Ownership and Rights

  • Users retain ownership of the content they post but grant Refov a non-exclusive, royalty-free license to use, display, and distribute such content within the platform.
  • Refov owns all other platform content, which is protected by intellectual property laws.

10. Service Availability

  • Refov strives to ensure continuous availability but does not guarantee uninterrupted service.
  • Refov reserves the right to perform maintenance and updates, which may temporarily affect service availability.

11. Limitation of Liability

  • Refov is provided "as is" without warranties of any kind.
  • Refov is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the platform, to the extent permitted by Slovak law.
  • Refov’s liability is limited to the amount paid by the employer for the specific placement in question.

12. Dispute Resolution

  • Users are encouraged to resolve disputes amicably by contacting Refov support.
  • If disputes cannot be resolved internally, they will be subject to the jurisdiction of the courts in Slovakia where Refov is registered.

13. Termination of Service

  • Refov reserves the right to suspend or terminate user accounts for breaches of these terms, harmful conduct, or legal obligations.
  • Users may delete their accounts at any time by contacting Refov support.

14. Governing Law and Jurisdiction

  • These Terms of Service are governed by the laws of Slovakia. Disputes arising from these terms will be resolved by the competent courts in Slovakia.
  • For users outside Slovakia, local consumer protection laws may also apply where relevant, but primary jurisdiction will remain with Slovak courts.

15. Additional Rules and Policies

1. Refov reserves the right to establish additional rules, guidelines, and policies that govern specific aspects of the platform’s operation, provided these do not conflict with these Terms of Service.

2. Such additional rules or policies will be communicated to affected users through email or platform notifications and will take effect upon notification.

3. Users are required to comply with any such rules or policies as a condition of continued use of the platform.

4. Refov reserves the right to take appropriate actions, including but not limited to account suspension or termination, for behaviors or patterns of use that undermine the platform’s trust and integrity, even if not explicitly covered in these Terms of Service.

16. Amendments to Terms

  • Refov may update these terms at any time.
  • Users will be notified of significant changes via email or platform notifications.
  • Continued use of Refov constitutes acceptance of the updated terms.

  • • Job Seekers: Create detailed profiles highlighting their skills, experience, and education to attract referrals for suitable opportunities.

2. Referral Invitations & Requests:

  • • Referrers: Explore job postings or receive notifications about relevant openings based on skill keyword matching. When they find a suitable job, they can send a referral invitation to a job seeker.
  • • Job Seekers: Search for jobs or receive notifications about relevant openings based on skills keyword matching. They can request a referral directly from a job posting, which is automatically sent to referrers whose skills match the job requirements.
  • Referrals are only initiated when both parties agree; referrers must accept requests, and job seekers must confirm invitations.

3. Evaluation (Pre-Interview by Referrers):

  • Referrers contact job seekers who accept invitations to conduct a detailed evaluation. This could include a discussion about skills, experience, and alignment with the job.

4. Hiring Process:

  • • Referrers: Submit a referral application on the platform for the evaluated candidate, ensuring they are the best fit for the role.
  • • Employers: Review the referral, conduct their own interviews, and make hiring decisions.

5. Bonus Payment:

  • After a successful hire, the employer pays 9% of the candidate’s annual salary to Refov. The referrer receives €800 for junior, €1,100 for middle, or €1,500 for senior positions if the candidate was hired through their application. Employers pay only Refov, making the process simple and secure for everyone.

This structured process ensures high-quality connections, incentivizes trust, and rewards all participants involved in successful hires.

  • • Profile Verification: Both employers and referrers go through a thorough registration and verification process, ensuring that only legitimate users participate in the platform.
  • • Skill Matching: Refov uses an advanced skill-matching system to ensure job seekers and referrers are connected based on relevant qualifications. Each referrer evaluates candidates within their area of expertise, and they are motivated to provide high-quality referrals to increase the likelihood of a successful hire and earn an incentive.
  • • Privacy Protection: Refov prioritizes user privacy by implementing strict data protection policies. Personal information and job applications are shared only with the parties involved in the referral process, ensuring confidentiality and security. Additionally, referrers, employers, and job seekers cannot see each other's contact details until a referral application has been created, protecting user privacy throughout the process.
  • • Referral Quality Control: Referrers are incentivized to make thoughtful referrals, and job seekers have the ability to accept or reject referral invitations, allowing both sides to ensure the connection is beneficial.
  • • Feedback System: A transparent feedback system allows users to rate and review each interaction, promoting accountability and helping maintain a high standard of service.

These measures foster trust, protect user data, and ensure that only quality referrals are made on the platform.

Refov is free to use for job seekers, referrers, and employers, with some restrictions to ensure fair use of the platform and to avoid spamming employers:

  • • Job Seekers: Can request up to 3 referrals per month for free, and there is no limit on the number of referral invitations they can receive. This essentially gives job seekers unlimited free options to receive referrals, allowing them to connect with multiple referrers. However, job seekers cannot request a new referral for the same job if a referral application has already been created for them by another referrer.
  • • Referrers: Can create up to 3 free referrals per month. Additional referrals require payment. Referrers are not allowed to create more than one application for the same job for the same job seeker. If a job seeker has 2 applications created for different positions at the same company, new applications cannot be created for the same company. If a referrer has 5 consecutive referrals rejected, regardless of whether the rejections are from the same company or different companies, they will be restricted from making referrals for 3 months.
  • • Employers: Can post job openings without any fee, making it easy for businesses to connect with potential candidates. Each job posting can have a maximum of 5 applicants, helping to prevent spamming and ensuring that employers receive high-quality applications.

These restrictions ensure a balanced and sustainable experience for all users while still providing plenty of opportunities to connect job seekers, referrers, and employers.

  • • Job Seekers: Can receive multiple referral offers from different referrers, meaning they can be referred to several jobs at the same time. However, even if they get multiple offers, they can only accept one job to work at. If they are hired by more than one company, they must choose one job to pursue, ensuring they only commit to one employer at a time.
  • • Referrers: Referrers can see all the referral applications made for their referred job seekers. If a job seeker applies to multiple companies through different referrers and is hired by more than one company simultaneously, only the referrer who helped the job seeker get hired by the company they choose to work for will receive the bonus. This ensures that referrers are rewarded based on the job seeker’s final decision on where they choose to work.
  • • Employers: After a successful hire, the employer pays 9% of the candidate’s annual salary to Refov.
